A. Privacy Policy

1. Your personal information including your name and email address will never be shared with a third party without your explicit consent or as required by law.
2. Pool commissioners will have access to their participants' member profiles including information that is hidden from other members.
3. Pool commissioners may send email through the pool website to the people in their pool. Sportsfan.com never sends unsolicited email.
4. Participants agree not to disclose their password to anyone under any circumstance.
5. Sportsfan.com automatically records information on our server logs from your browser, including your IP address and the page you request. This information is used only to identify problems related to our website structure and will not be released to a 3rd party. Pool commissioners can view the IP address of person's making picks at their website.
6. Any questions or concers regarding this policy should be addressed to info@sportsfan.com.
7. This policy is subject to change. You are advised to refer to the privacy policy on a regular basis.

B. Gambling/Wagering Disclaimer

SPORTSFAN.COM AND ITS AFFILIATED WEBSITES ARE NOT GAMBLING WEBSITES. "THE SERVICE" DOES NOT INCLUDE THE PLACEMENT OR ACCEPTANCE OF BETS OR WAGERS.

The Service Provider does not recommend, advise or participate in gambling activities. All material and information provided by The Service Provider is for entertainment and informational purposes only and shall not be construed as the placement, acceptance, or recommendation to place or accept any wagers or bets.

C. User Agreement

Internet Real Estate Group LLC and Leapy Dog Productions, Ltd. ("The Service Provider") provide a website service ("The Service") which allows individuals to run a sports pool or contest using specially-designed website software.

Use of the pool or contest website service indicates consent to the following user agreement. The terms of this license agreement are subject to change and it is recommended that you check these terms from time to time.

This website and service are for entertainment purposes only. Sports gambling, sports pools including basketball pool or contests and football pool or contests, while common, may not be legal where you live. If running a league/pool or contest or participating in a league/pool or contest violates any laws that apply to you, you are expressly forbidden from using this website. It is your sole responsibility to ensure that you comply with such laws. The Service Provider makes no representation as to the legality of your actions as it is impossible for us to determine the state of the law in every jurisdiction around the world on an ongoing basis. Therefore it is your responsibility to determine the legality of use in your jurisdiction, and we assume that you believe your actions to be legal if and when you use any of our products and/or services.

Although The Service Provider has a strict policy of checking all software made available for downloading using up-to-date virus scanning technology, The Service Provider cannot and does not guarantee or warrant that files available for downloading through the site will be free of infection or other properties which may damage your system. You acknowledge that you are responsible for implementing sufficient procedures to satisfy your particular requirements and to protect the safety of your computer and the data contained therein.

YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE SOFTWARE. The Service Provider provides the site and software "as is" and does not make any express or implied warranties, representations or endorsements with regard thereto. Your Use of the Site

HACKING); AND/OR 3) DISTRIBUTE INTERNET VIRUSES OR ENGAGE IN ANY SIMILAR ACTIVITIES.

Limitation of Liability
THE SERVICE PROVIDER IS NOT LIABLE FOR ANY DAMAGES EITHER CONSEQUENTIAL, SPECIAL, OR OTHERWISE, THAT MAY RESULT FROM THE USE OR THE INABILITY TO USE MATERIALS OR INFORMATION PROVIDED ON OR BY THE SITE.

You agree to defend, indemnify and hold harmless, The Service Provider, its officers, managers, agents, employees, affiliates, sponsors, and advertisers from any claims, losses, damages, judgments, settlements or costs, related to your failure to comply with your obligations under the terms of use, your use of the site or any software or services contained therein, your placement of content submitted, posted, transmitted or made available through the service or on the site, or your violation of any rights of another. You agree to cooperate to the best of your efforts, with us during the defense of any such claim and to reimburse The Service Provider its legal fees and costs associated therewith.

The Service Provider explicitly reserves the right, in its sole discretion to: 1) Censor any web site that, in LThe Service Provider’s sole discretion, is deemed inappropriate; 2) Review every account for excessive space and bandwidth utilization and to terminate those accounts that exceed allowed levels; 3) Terminate your service for unsolicited, commercial e-mailing (i.e., SPAM); illegal access to other computers or networks (i.e., hacking); distribution of Internet viruses or similar destructive activities; non-payment of fees; and any other activities, whether lawful or unlawful, that The Service Provider determines to be harmful to its other customers, operations, or reputation;4) Terminate your service if the contents of your web site result in, or are the subject of, legal action or threatened legal action, against The Service Provider or any of its affiliates or partners, without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit.

The Service Provider will employ good-faith effort to maintain the server and prevent loss of files and/or loss of service. No guarantees are provided as to the amount of "downtime" (when the website is not available due to computer server maintenance or error) and you understand that loss of data can occur due to fire, power loss, and other events and you agree to indemnify and hold harmless, The Service Provider, its officers, managers, agents, employees, affiliates, sponsors and advertisers from any claims, losses, damages, judgements, settlements or costs, related to technical difficulties with the server due to any cause.

Ownership of Intellectual Property
The Service Provider is the owner of all copyrights, trademarks, trade names, logos, graphics, and other intellectual property contained in this site and in the software except where otherwise noted. The entire contents of this site and the software are protected by applicable federal, state, and international copyright and trademark laws. YOU SHALL NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE THE SOFTWARE OR THE MATERIAL ON THIS SITE, INCLUDING TEXT AND/OR GRAPHICS, WITHOUT THE EXPRESS PERMISSION OF THE SERVICE PROVIDER.

When you purchase the software for download, you will have a limited license to access and use the software only for the purposes described by The Service Provider. You may not edit, reproduce, copy, or redistribute, in whole or in part, any of the software without the express written consent of The Service Provider.

Modification of Terms
The Service Provider reserves the right to modify, amend, or terminate these terms of use at any time without advanced notice. Changes in these terms will be posted promptly, and you are recommended to check these terms from time to time.

Modification or Termination of Service
The Service Provider reserves the right to modify, amend or terminate the service provided temporarily or permanently without prior notice. You agree that The Service Provider may terminate your ability to use the service, and any future use, for any reason including your failure to abide by these terms of service. You agree that The Service Provider shall not be held liable for your inability to access the service, or for the discontinuance or termination of the service.

THIS AGREEMENT SHALL BE DEEMED ENTERED INTO IN THE STATE OF NEW JERSEY. THE LAWS AND JUDICIAL DECISIONS OF NEW JERSEY SHALL BE USED TO DETERMINE THE VALIDITY, CONSTRUCTION, INTERPRETATION AND LEGAL EFFECT OF THIS AGREEMENT. YOU AGREE THAT ANY ACTION RELATING TO OR ARISING OUT OF THIS AGREEMENT, SHALL BE BROUGHT IN THE COURTS OF NEW JERSEY, AND YOU CONSENT TO PERSONAL JURISDICTION IN NEW JERSEY.
